Judgment
ORDER
This transfer petition is filed for transferring SA 210/2025 pending on the file of DRT-II, Chennai to be transferred to DRT, Coimbatore for trial along with SA 95/2023.
SA 95/2023 was filed challenging the sale notice and SA 210/2025 is filed challenging the order passed under Section 14 of the SARFAESI Act.
It is further submitted that parties and secured interest involved in both the securitization application are the same and thus, transfer is sought.
Learned counsel for the respondent-Bank though has no objection for transfer, but, submitted that there is no reason for joint trial and disposal.
Considered the rival submissions and perused the records.
The idea of transferring the connected matters to a particular Court/Tribunal is only to take joint trial/enquiry of the matters for avoiding unnecessarily spending time in independently hearing the matters and also for avoiding conflict of views in the orders. Therefore, this Tribunal is of the view that both the matter shall be tried together, however, left open the option to the learned Presiding Officer, DRT, Coimbatore to decide the issue as to whether any independent enquiry or common enquiry is required in both the matters.
In the said circumstances, this Tribunal directs that SA 210/2025 pending on the file of DRT-II, Chennai is ordered to be transferred to the file of DRT, Coimbatore.
The learned Presiding Officer, DRT-II, Chennai, is directed to send the records to DRT, Coimbatore after duly indexing the material and immaterial records, within a period two weeks from the date of receipt of a copy of this order. On receipt of all the records, the learned Presiding Officer, DRT, Coimbatore, is directed to take the case on file immediately and proceed to dispose the case in the manner known to law and on merits as expeditiously as possible.
In the result, this TP 1/2026 is ordered accordingly.
Parties shall bear their own costs.
Pending IAs, if any shall stand closed.
