Case called out intermittently.

None appears for the appellant, neither the learned counsel nor the proxy counsel nor anybody else on her behalf.

The perusal of the record shows that the matter is pending since 2022 and the defects as pointed out by the Registry have not been cured so far.

The proceedings dated 1.12.2022, 16.02.2023, 18.04.2023, 20.06.2023, 14.08.2023, 04.10.2023 and 14.12.2023 may be referred to in this regard which show that the defects as pointed out by the Registry have not been addressed and cured.

Today when the matter has been taken up, none has appeared for the petitioner. The office report dated 09.01.2024 shows that the defects still remained uncured.

The instant Second Appeal stands dismissed in non-prosecution.

However, in the interest of justice, it may be observed that if the petitioner wants to pursue the matter in right earnest with due diligence, she may move appropriate application seeking recall of the instant Order and restoration of the Petition in accordance with law.

The Registry is requested to send a copy each of this Order to the parties of the Second Appeal and to the learned counsel for the appellant as well as to the fora below within three days from today. The stenographer is requested to upload this Order on the website of this Commission within three days from today.
