P. Jyothimani, J.—The petitioner is qualified to be appointed in the post of Secondary Grade teacher and he has registered himself in the

Employment Exchange. The grievance of the petitioner is that when the counseling was going on, the persons who were already appointed and

working as Secondary Grade teachers in the time scale of pay in the Government Aided and private schools and who have not intimated about

their employment in the above said schools to the Employment Exchange, by canceling the registration, have also appeared for counseling. In view

of the same, the petitioner has made a representation to the 3rd respondent on 31.8.2006 bringing out the fact that the persons who have already

employed, also attended the counseling.

If that be true, it requires a serious consideration and the 3rd respondent has got the duty to investigate and prevent such persons from

participating in the counseling.

I have heard the learned Counsel for the petitioner and the learned Government Advocate taking notice on behalf of the respondents.

In view of the fact stated above, the 3rd respondent is directed to consider the representation of the petitioner dated 31.8.06 regarding

exclusion of persons who are already appointed and working as Secondary Grade Teachers in time scale of pay in the Government aided and

private schools and pass appropriate orders within a period of eight weeks from the date of receipt of a coy of this order.

With the above direction, the writ petition is disposed of. No costs. Consequently, connected M.P. is closed.
