This writ petition has been filed by the petitioner aggrieved of the order dated 28.07.2023 (Annex.6), whereby the respondent No.5 has been engaged as ‘Anganwadi Karyakarta’ on temporary basis.
Submissions have been made that the petitioner has not been awarded marks, to which she is entitled on account of her holding RSCIT and her status as a Deserted Woman and in case, those marks are awarded, the petitioner would be having higher marks than the respondent No.5.
Further submissions have been made that the petitioner has made a representation to the District Collector, however, no cognizance of the same has been taken.
Having considered the submissions made by learned counsel for the petitioner, as under the circular dealing with the appointment of ‘Anganwadi Karyakarta’ against the order passed by the Child Development Project Officer dated 28.07.2023, appeal has been provided to the Deputy Director, Integrated Child Development Services and further second appeal is provided, filing of the writ petition directly before this Court cannot be countenanced.
In view of the above, the petition filed by the petitioner is dismissed leaving it open for the petitioner to file appropriate appeal before the competent authority. In case, such an appeal is filed by the petitioner, it is expected of the appellate authority to decide the same on merits expeditiously.
