This matter is taken up through hybrid mode.

Learned Counsel for the Petitioner is absent on call.

During Course of hearing, it came to the notice of this Court that in paragraph No.6 of the order dated 07. 02.2024, inadvertently, the year of the Writ Petition has not been indicated. This being a typographic error, the same be read as “W.P.(C) No.29114 of 2020”.

As per the office note, the report called for from the District Judge, Puri, is yet to be received.

As is ascertained from the record, pursuant to order dated 07.02.2024, a letter was issued by the Superintendent, Writ Branch-VI to the District Judge, Puri, vide issue no.5741 dated 12.02.2024 inclosing thereto a copy of the order dated 07.02.2024 and it was also sent through mail on the very same day to the District Judge, Puri. The contents of the said letter is extracted below:-

The  District  Judge,  Puri, At/PO/Dist.-Puri.

Sir,

I am directed to request you to submit a report, as to reason for not acting in terms of the order passed by the coordinate Bench in W.P.(C) No.29114 of 2020 for conclusion  of  the  proceeding  in ARBP No.124 of 2017, vide Court’s order No.4 dtd.07.02.2024 passed in W.P.(C) No.42599 of 2023 (Copy of the order enclosed herewith).

This  may  be  treated  as most urgent.

This case stands adjourned to week commencing from 19th February, 2024.

As it ascertained from the contents of the said letter, it was indicated in the said communication that the matter is to be treated as the most urgent and it was further indicated that this case stands adjourned to week commencing from 19.02.2024. Despite such communication, no report has come from the concerned court.

In view of the above, the Register (Judicial) is directed to call for a Report from the concerned Court with regard to alleged non-compliance of order passed by the coordinate Bench in W.P.(C) No.29114 of 2020 so also order of this Court dated 07.02.2024 in the present writ petition, to be submitted within a week hence.

Matter be listed on 12th March, 2024.
