This petition has been filed by the petitioner being aggrieved by the order of transfer dated 7.7.2023 (Annexure P-4), whereby she has been transferred from Parasia2:20:10 PM Beat Area, West Chhindwara Forest Division to the Kohnala Beat, Delakhari District Chhindwara.

Contention of the learned counsel for the petitioner is that the petitioner was earlier posted at Delakhari forest area, at that time she was attacked by certain criminal persons, which resulted in lodging an FIR and the criminal case under Sections 353, 186, 332, 294 and 506 of IPC is pending before the Tamia Link Court, District Chhindwara. It is stated that whenever the petitioner goes before the Tamia Court, she was threatened and harassed by the accused persons there to withdraw the case. Under such circumstances, she is under apprehension that if she joins at Delakhari again, there will be a threat to her safety and life. It is prayed that she may be transferred to any other range other than Delakhari where she has been transferred now. A representation in this regard is also pending before the authority concerned.

Considering the submission and apprehension of the petitioner, this petition is disposed of with a direction to the respondent No.2/ Division Forest Officer, District Chhindwara to consider the representation of the petitioner, as she is having a valid apprehension that she might be attacked, if she is posted again at Delakhari range, and the respondent No.2 may consider her application for transfer to some other range. Let this exercise be completed within a period of 15 days from the date of receipt of certified copy of this order passed today.

Till then she may be permitted to continue at the present place of posting, if not already relieved.
