Judgment
Ravi Malimath, J
The appellant's counsel is absent. She was absent even on 24th September, 2021.
We have heard learned counsels for the respondents.
Aggrieved by the order dated 20.12.2012, passed by the learned Single Judge, in CWP No. 6888 of 2011, in holding that the writ petitioner shall cease to work as Secretary to respondent No. 2-Society forthwith, while directing respondent No. 2-Society therein, to commence fresh selection process, the writ petitioner has filed this appeal.
By the order dated 01.02.2013, notices were issued to the respondents with an interim order to the effect that the petitioner is permitted to work as Secretary with the respondent-Society.
Learned senior counsel appearing for the counsel for respondent No. 2 submits that subsequent to the order passed by the learned Single Judge and in spite of the interim order being granted, the appellant, namely, the writ petitioner, has not reported for duty. That the order of the learned Single Judge was passed in the year 2012. Since then the appellant has not reported for duty. Hence, without going into the merits of the case, it is suffice to hold that the appellant having abandoned the work, is not interested to prosecute this appeal. That in case the appellant was interested, she would have taken benefit of the interim order and would have reported for duty. Even that has not been done. Probably for this reason also, there was no representation even on the previous date of hearing. Hence, we find no good ground to proceed further in the matter. Accordingly, the appeal is dismissed.
The pending miscellaneous application is also disposed off.
