Rule. Learned Additional Public Prosecutor waives service of Rule on behalf of the respondent – State of Gujarat.
The present application has been filed by the convict to release him on temporary bail on the ground of completion of legal work of the property.
I have heard learned advocate appearing for the applicant and learned Additional Public Prosecutor for the respondent-State as well as considered the averments made in this application.
It emerges from the record that against the sentence of seven years imprisonment, the convict served out the sentence of more than one year and ten months including the period of set-off. In the month of June 2021, he has enjoyed parole leave for a period of 90 days. No case is made out at this stage for release the convict on temporary bail. The reason stated in the application also does not inspire confidence to use judicial discretion in favour of the convict to release him on temporary bail. Hence, the application stands dismissed. Rule is discharged.
