Judgment
Alok Singh, J.—I have gone through the record.
The allegation of the Petitioner is that the Respondents are willfully disobeying the orders of this Court as the undertaking given by them was
only to mislead the Court and cheat the Petitioner in Company Petition No. 144 of 1987. Respondents have given an undertaking that they shall
replace the Petitioner as the guarantor of the Company. In reply, Respondents have specifically averred that they have not violated any order of
this Court because the Company petition in which the order was passed was dismissed vide COCP No. 841 of 1995 order dated 06.09.1990
and further the appeal was also dismissed by a Division Bench on 13.08.1992. It is further replied that as per the undertaking the guarantees by
Group headed Surjeet Kaur had already furnished with the Bank. Respondents have also tendered unqualified apology. As such, no case of
contempt of court is made out u/s 12 of the Courts Act.
Present petition is dismissed.
