Mohammad Rafiq, J.—Heard learned Counsel for Petitioner as well as learned Public Prosecutor and perused material made available to me during arguments.

First bail application of Petitioner was rejected by this Court vide order dated 27.07.2010, however, with liberty to Petitioner to again apply for bail after statements of prosecution witnesses, namely, Gordhan Singh and Dhan Singh are recorded. Those two witnesses have turned hostile. Learned Counsel for Petitioner therefore submits that no case is made out against Petitioner and there is no likelihood of Petitioner being convicted. Petitioner is in jail since 23.04.2010.

Learned Public Prosecutor opposed the bail application.

After considering all facts and circumstances of case and without expressing any opinion on its merits and demerits, I deem it just and proper to release accused-Petitioner Jugraj Singh Son of Shri Nathu Singh, Resident of Padliya, Police Station Mangrol, District Baran, on bail u/s 439 Cr.P.C., in FIR No. 73/2010, Police Station Mangrol, for offence under Sections 147, 148, 149, 341, 323, 324, 325, 308 and 302 IPC, provided he furnishes a personal bond in the sum of Rs.30,000/- with two sureties of Rs. 15000/- each to the satisfaction of the trial court for his appearance on all subsequent dates of hearing and as and when called upon to do so.
