Judgment
Kurian Joseph, C.J.—The petition is filed with the following prayers:
This Hon''ble Court may be pleased to issue a writ of Certiorari quashing order dated 19.9.2002 (Annexure P 4) order dated 11.12.2002 (Annexure P 6) and order dated 1682007, Annexure P 8 and reinstate the Petitioner with all consequential benefits.
That alternatively, this Hon''ble Court may kindly quash the impugned orders and direct the Respondent Bank to take a lenient view in the matter and inflicting upon the Petitioner punishment which is not harsh as terminating/dismissing the Petitioner from service or give appointment to the Petitioner on any post in the Respondent Bank as per his qualification to meet the ends of justice.
Heard learned Counsel for the Petitioner and the learned Counsel appearing for the Bank. There is No. dispute that the Petitioner has availed all the statutory remedies. But the only submission is that the Bank appears to have taken a lenient view in such cases by giving alternate accommodation in view of the long service. Therefore, the Petitioner prays for an opportunity to seek the indulgence of the Bank. It is always open to the Petitioner to do so.
The writ petition is disposed of with liberty to the Petitioner to approach the Bank itself for appropriate indulgence. Pending application(s), if any, also stands disposed of.
