Judgment

This present petition has been filed under Article 226 of the Constitution of India seeking the following reliefs:-
“ i. Issue Rule Calling upon official respondents to show cause as to why writ in the nature of mandamus and/or any other Order shall not be issued whereby modifying the Order dated, 15.09.2023 issued by the District Magistrate and Collector, West Tripura, District to extent, that, on promotion to the post UDC, Group-C, the petitioner will be placed in the play level-10 of Tripura Pay Matrix-2018(corresponding to Rs.5700-24000/- under PB II GP-4200/- and with actual financial benefit on promotion w.e.f. the date on which juniors to the petitioner supersede the petitioner, in the matter of promotion to the post of UDC, Group-C as per the recommendation of DPC, held on 18.09.2014 for consideration of promotion under District(Revenue Administration).
ii. Issue Rule calling upon the respondents to show cause as to why writ in the nature of mandamus and/or any other Order shall not be issued whereby directing the official Respondents to give benefit of MACP-II to the petitioner on completion of 8 years continuous and satisfactory service in the same post without any promotion, as UDC w.e.f. 18.09.2014 with all other consequential incidental service benefits including the arrear of pay and salary with interest @ 9% per annum.”
Heard learned counsel appearing for both the parties and perused the evidence on record.
It is seen from the record that the petitioner has submitted a representation dated 13.03.2023 before the respondents and the same is pending till date. As such, without expressing any opinion on its merits, this present writ petition is disposed of with the direction upon the respondents to consider the representation dated 13.03.2023 submitted by the petitioner before the respondents in the light of the proceedings made by the Senior Deputy Magistrate, O/o the D.M. and Collector, West Tripura on 05.08.2022 and also the separate request made by the petitioner for considering his case for entitlement to MACP-
II. This exercise shall be completed within a period of 3(three) months from the date of receipt of the copy of this order by the respondents. Such a decision shall also be communicated to the petitioner by the respondents.
With the above observation and direction, this present writ petition is disposed of. Stay if any stands vacated. Pending application(s), if any also stands closed.
