Judgment
Thomas P. Joseph, J.—Petitioners are accused 1 to 4, in Crime No. 1222 of 2010 of Mattanchery Police Station originally registered for offences punishable under Sections 498A, 506(ii) and 306 r/w Section 34 of the Indian Penal Code. Allegation is that due to cruelty, wife of the brother of first Petitioner attempted to commit suicide on 12.10.2010. This criminal miscellaneous case is filed to quash proceeding against Petitioners on the strength of a settlement. The second Respondent has sworn an affidavit stating that the dispute is settled. Learned Public Prosecutor submitted that on 15.10.2010 the investigating officer has submitted a report before the learned Magistrate reporting that allegations against Petitioners are false.
In the light of that submission, it is not necessary to pass any orders on this criminal miscellaneous case. I make it clear that if it becomes necessary for Petitioners to move this Court again in the matter, it will be open to them to do so.
Resultantly with the above observation this criminal miscellaneous case is closed.
