Judgment
This petition in the nature of habeas corpus has been filed by the petitioner seeking production of his wife ‘M’, with the allegations that his wife was missing since 03.12.2022 and there is likelihood that she is under illegal detention.
By order dated 07.02.2023, the copy of the petition was directed to supplied to learned Additional Advocate General and he was required to file a factual report.
On 16.02.2023 it was indicated that efforts are being made to locate the corpus.
Today, the respondents have produced the corpus before the Court with the indications that the corpus was recovered from Lathi Dar, District Batala (Gujarat) and that she was living with one Punaram and that her statements were recorded, wherein she has indicated that she was willingly living with Punaram and does not want to go with petitioner, Jora Ram.
On being produced before the Court, the Court has interacted with the corpus, who has reiterated what has been indicated in her statements before the police regarding her unwillingness to go with Jora Ram and to continue to stay with Punaram.
The copy of Aadhar Card of corpus ‘M’, produced by the investigating officer, has been taken on record.
In view of above fact situation, wherein the corpus has been produced before the Court and on interaction, she has indicated that she is not in any illegal detention, no case for interference is made out in the petition.
The petition is, therefore, dismissed. The corpus is free to go wherever she wants to go.
