The prayers in the instant Writ Petition (Criminal) seeking for Habeas Corpus are as follows:

"

i. Issue a writ of Habeas Corpus, commanding the respondents 1 and 2 to produce the children of the petitioner and release them from the illegal custody/detention of the third respondent and her people.

ii. Petitioner also prays that this Hon'ble Court may be pleased to dispense with the translation of the documents produced in the vernacular language.

AND

iii. Grant such other order or direction as this Honourable Court may deem fit and proper in the facts and circumstances of the case."

Sri.Gireesh Pankajakshan, learned Advocate instructed by Ms.M.Ananya, learned counsel appearing for the petitioner, would submit on the basis of instructions that the petitioner would seek leave of this Court to withdraw this Writ Petition (Criminal) and with liberty to approach the Family Court concerned (The Family Court, Mavelikkara) to file an Original Petition, seeking for custodial and visitational rights of his minor child born in his wedlock with R-3.

Smt.Gisa Susan Thomas, learned counsel appearing for contesting respondent No.3 submits that her party has no objection to the said course of action.

Recording the submissions of the petitioner, the above Writ Petition (Criminal) will stand dismissed as withdrawn with the abovesaid liberty.
