Judgment
The petitioner is the accused in O.R.No.2 of 2021 of Peruvannamuzhi Forest Station, Kozhikode District. The offences alleged against him are under Sections 2(16), 2(20), 9, 39, 50 and 51 of the Wild Life (Protection) Act, 1972. The allegation is that the petitioner was found in possession of 500grams of fat of Python(Genus Python), which is an animal belonging to Schedule I, Part II, Item No.14A of the Wild Life (Protection) Act, 1972 along with a country gun, air gun, the balls of country gun and a knife which was used to kill the python. For possessing the arms and ammunition, another Crime No.42 of 2021 of Pezhuvannamuzhy Police Station was also registered. Petitioner was arrested on 03.03.2021 and has been in custody since then.
The learned Public Prosecutor has vehemently opposed the application for grant of bail. However taking note of the circumstance of the case and the fact that the petitioner has been in custody from 03.03.2021, I am inclined to grant bail to the petitioner subject to conditions.
Petitioner is therefore granted bail in O.R.No.2 of 2021 of Peruvannamuzhi Forest Station and he shall be released on bail(if not required to be detained otherwise) on his executing a bond for Rs.50,000/-(Rupees fifty thousand only) with two solvent sureties each for the like sum to the satisfaction of the jurisdictional Magistrate and subject to the following conditions:
(a) One of the sureties shall be a close relative of the petitioner.
(b) Petitioner shall report to the investigating officer on every Saturday between 10.00 am and 12.00pm until filing of the final report.
(c) Petitioner shall report to the investigating officer as and when required for interrogation.
(d) Petitioner shall not get involved in any offence during the period of this bail.
(e) Petitioner shall not intimidate or influence the witnesses.
(f) In case any of the condition nos.(b) to (e) are violated, it is open to the investigating officer to file application before the learned Magistrate for cancellation of the bail granted hereby.
