Judgment
R.B. Misra, J.—The writ petition has been filed with the following prayer:
That a writ in the nature of Mandamus may kindly be issued directing the respondents to consider the petitioner for his conversion into daily waged Chowkidar w.e.f. 1.1.2004 as per instructions contained in the notifications dated 27.2.2004 & 13.10.2009 issued by the Chief Secretary to the Govt. of H. P., with all consequential benefits like arrears of wages
It is not disputed by the parties that the issue in controversy involved in the present case is squarely covered by the decision of the this Court in CWP No. 2465 of 2011, dated 23.5.2011 (Roshan Lal & Anr. Versus State of H. P. and Anr.), the relevant portion of the judgment reads as under:
The petitioner is working as part time Revenue Chowkidar. The State Government, in its wisdom, has framed a scheme to grant daily wager status to the part time workers on 27.2.2004. The Government has framed subsequent policy as well. The respondents are directed to consider the case of the petitioner for giving the status of daily wagers within eight weeks from today. The writ petition is disposed of, so also the pending applications, if any.
In this view of the matter, the present writ petition is disposed of in the light of the above judgment. The pending applications, if any, also stands disposed of.
