Judgment
Alok Singh, J.—This is an application seeking anticipatory bail in case FIR No. 55 dated 19.3.2011 under Sections 498/406 IPC, Police
Station Beas, District Amritsar.
This Court vide order dated 5.4.2011 has directed to release the Petitioners on interim bail.
Learned Counsel for the Petitioners states that Petitioners have already been released on bail and the Petitioners have joined the investigation
and shall join the investigation as and when asked to do so by the Investigating Officer.
Mr. K.D. Sachdeva, learned Assistant Advocate General, Punjab, on instructions from ASI Sukhpal Singh, who is personally present in Court,
states that all the dowry articles have already been recovered, therefore, custodial interrogation is not required at all.
Mr. R.S. Bajwa, learned Counsel appearing for the complainant states that motorcycle and one gold kara weighing about two tolls are yet to be
recovered.
Since custodial interrogation is not requested by the prosecution agency, therefore considering totality of the facts and circumstances of the case,
petition is allowed. Order dated 5.4.2011 is made absolute.
