Judgment
Mr.Samir Kumar Mishra, learned counsel appears and files Vakalatanama on behalf of opposite parties-Odisha State Civil Supplies Corporation Limited in Court. The same be kept on record.
The Tender Call Notice No.1181 dated 24.04.2023 (Annexure-2) for selection and appointment of Level-II contractor for transportation of Custom Milled Rice (CMR) from Rice Receiving Centre (RRC) to Retail Centre (FPS) for the year 2023-25 is under challenge in this writ application.
In course of hearing, Mr. Mishra, learned counsel appearing for the Odisha State Civil Supplies Corporation Limited, Puri submits that the last date of filing of bid was on 09.05.2023. The technical bid was opened on 11.05.2023 and the price bid had already been opened on 18.05.2023. After the above, the bid has already been finalized on 22nd May, 2023.
From the records, it appears that the petitioner was not a bidder in the tender in question.
In that view of the matter, this Court is not inclined to interfere with the Tender Call Notice.
Accordingly, this Court without interfering with the Tender Call Notice No.1181 dated 24.04.2023 (Annexure-2) disposes of the writ application, keeping the question of law raised in the writ application open to be decided in the appropriate case.
