I.A. No.18595/2021, an application for urgent hearing is taken up, considered and allowed for the reasons mentioned therein.
The applicant has filed this first bail application u/S.439 Cr.P.C for grant of bail.
In brief, the case of the prosecution is that on 25.6.2020, wife of the applicant-accused Smt. Priyanshi lodged Dehati Nalishi at Police Station Gwalior
saying that her mother-in-law Taradevi, W/o Shailendra Singh Chauhan was killed by unknown person.
On her report, Crime under Sections 302/201 of IPC bearing Crime No. 325/2020 was registered at Police Station Gwalior, District Gwalior (MP) and
the matter was investigated. During investigation, statement of Gajendra was recorded. In his statement he narrated that before him the accused
admitted that due to dispute regarding immovable property, he had killed his mother and Dog Master Constable Dharmendra narrated that the dog
identified the applicant-accused Jitendra as the culprit.
Looking to the nature and gravity of offence, this Court is not inclined to grant the benefit of bail to the applicant.
Accordingly, the application filed under Section 439 of Cr.PC. is hereby dismissed.
