The grievance of the applicant is that the learned Trial Court, Special Judge (PC) Act, Indore has declined to accede to take cognizance against some public servant (respondent nos.1 to 7) along with some other private persons (respondent nos.8 to 21) without obtaining prosecution sanction from the appropriate authority while according to the applicant in the change of circumstances (retirement of respondent nos.3 to 5 and transfer of respondent nos.2,6 and 7) such prosecution sanction is not required.

Learned trial Court has dismissed his application to the effect vide impugned order dated 22.01.2018 observing that his prayer of similar nature has been dismissed twice earlier vide order dated 09.11.2012 and 06.09.2016 which have not been challenged by the applicant before any higher court, therefore, they are in existence and until and unless these orders are in force, the Court cannot deviate from its earlier stand.

Relevant facts in brief are that a private complaint filed by the applicant before the Special Judge, PC Act, Indore against 7 public servants and 13 private persons alleging misappropraition of public fund issued by the Central Government for implementation of “Common Services Center Scheme” by abusing their official position.

The cognizance of this complaint was kept in abeyance by the learned Trial Court observing that prosecution sanction under Section 19 of the PC Act is necessary for taking cognizance.

The complainant filed an application on 02.11.2012 for granting exemption from filing of prosecution sanction at the stage of registration of crime. He also stated that the Act of public servant does not fall within the purview of the act done or purportedly to be done in the discharge of their official duty, therefore, he may be exempted from filing prosecution sanction at that stage. The learned Trial Court observing that the complaint has been filed under Section 13 (1) (D) and also under Sections 467, 468, 471, 420, 109, 120-B read with 34 of IPC and as per section 19 of Prevention of Corruption Act cognizance of any offence under Sections 7, 10, 11,13 and 15 cannot be taken without sanction of the authority mentioned in Section 19 (1) of the PC Act and this provision is mandatory, therefore, further proceedings of the complainant are kept in abeyance. Then he made an attempt by approaching the Court to take cognizance at least against the respondent Nos.8 to 21 who are private persons and against whom sanction was not required and they may be proceeded further and prosecuted for the allegation made in the complaint. His prayer was turned down stating that when prosecution cannot be initiated without proper sanction against the public servant then private persons also cannot be prosecuted separately. fn;s tkus dk fuosnu fd;k] tks fn;k x;kA fu;r fnukad ij vko';d #i ls vfHk;kstu Lohd`fr izLrqr dh tkosA izdj.k mDr dk;Zokgh gsrq fnukad 13-10-2016 dks is'k gksA** In his 3rd attempt, the complainant again approached the learned Trial Court stating that some of the public servant against whom the allegations have been made in the complaint have been retired and some of them are now transferred, therefore, now the prosecution sanction against them is not required and they may be prosecuted and complaint may be proceeded further. This time he was again not granted any opportunity and the learned Trial Court dismissed his prayer stating that earlier orders dated 09.11.2012 and 06.09.2016 have attained finality and therefore, nothing is there to deviate from the earlier view. The order dated 22.01.2018 reads thus:-

We have heard learned counsel for the applicant at length and perused the three orders of the learned Trial Court and also considered the facts stated in the petition and other documents.

The learned Trial Court has refused to accede the prayer of the applicant observing that on earlier two occasions it has declined the prayer of the applicant, therefore, now 3rd time also the prayer cannot be entertained but as is clear from the three orders of the learned Trial Court quoted above that at two earlier occasions the request made by the applicant was different from the 3rd request, which is subject matter of the present petition. At first occasion, the applicant requested the Court that he may be exempted from filing of prosecutions sanction at that stage i.e. stage of registration of complaint. On second occasion he requested that until he obtains the prosecution sanction, private persons may be separated from the public servants and may be prosecuted separately for illegalities committed by them and on 3rd occasion now the complainant agitate his grievance stating that in the changed circumstance, which is retirement and transfer of some public servant, the prosecution sanction is not required. Thus, learned Trial Court failed to appreciate the prayer of the applicant in its right prospective. The current prayer of the applicant is different from the prayer made by him on earlier two occasions, therefore, dismissal of the present prayer on the ground of existence of the earlier orders is incorrect.

In view of the aforesaid, we allow the present petition of the applicant and remit the case back to the learned Trial Court for reconsideration of the prayer of the applicant and to pass appropriate order in accordance with law.

With the aforesaid, the present petition stands allowed and disposed of.
