Ram Chand Gupta, J.—The present petition has been filed u/s 439 of Code of Criminal Procedure for interim bail to Petitioner -Jitender Singh @Karan in FIR 84 dated 03.04.2010, under Sections 302/404/201/34 IPC, Police Station Taraori, Karnal, District Karnal on the ground that his wife has recently delivered a child and there is nobody to look after her in the house.

I have heard learned Counsel for the parties and have gone through the whole record.

It has been stated by learned Counsel for the State that the fact has been got verified that the wife of the Petitioner has delivered a child on 22.11.2010. Further contended that there is nobody else in the said house except minor children of the Petitioner. It has also been stated that brother and other family members of the Petitioner though residing in the same village and however, they are residing in different houses and in different localities.

There are no allegations on behalf of the State that Petitioner is likely to abscond or that he is likely to dissuade the witnesses from deposing true facts in the Court, if released on bail.

The case is at the stage of evidence of prosecution.

Hence, keeping in view these facts and without expressing any opinion on merits, the present application for interim bail filed on behalf of Jitender Singh @Karan is accepted and is granted two weeks'' interim bail to the satisfaction of Chief Judicial Magistrate, Karnal with the condition that he will surrender after completion of two weeks'' interim bail.
