An advertisement appeared in the local newspaper dated 18.09.2006, whereby applications were invited for Indane distributorship at Baddi by respondent No. 1. Petitioner was called for interview on 15.10.2010. He was duly interviewed. However, since the petitioner has not furnished the original documents at the time of interview, he was found ineligible. Respondent No. 2 was selected as per Annexure P-4. It has come in the reply filed on behalf of respondent No. 1 that as per Clause-19(e) of the advertisement, if original documents were not produced at the time of interview, the candidate would be declared ineligible. The same condition was incorporated in Annexure P-3, dated 27.09.2010. Petitioner has failed to produce the original documents at the time of interview on 15.10.2010. It was made clear to all the candidates that non-production of any of the documents could lead to disqualification.
Mr. Suneel Awasthi, learned counsel for the petitioner has strenuously argued that the petitioner in fact has placed the F.D.Rs. with the Bank. However, no tangible evidence to this effect has been produced either before this Court or before the Selection Board on 15.10.2010.
Accordingly, there is no merit in this petition and the same is dismissed, so also the pending application(s), if any.
