Judgment

Petitioner is the 3rd accused in Crime No.521 of 2018 of Njarakkal Police Station, Ernakulam which is now pending as L.P.No.20 of 2021 on the files of the Judicial First Class Magistrate's Court, Njarakkal. The offences alleged against the petitioner are under Sections 323, 324, 326 and 308 r/w Section 34 of the Indian Penal Code, 1860.
After the alleged incident, petitioner had absconded and did not appear before the court. Due to his absence, the case against him was split up and has been transferred to the Long Pending Register. Petitioner is now willing to appear before the court and participate in the trial. The proceedings under Sections 82 and 83 of the Cr.P.C. have already been initiated.
Since the petitioner has expressed his willingness to appear before the court and participate in the trial, I am of the view that this Crl.M.C. can be disposed of with a direction.
Accordingly, if the petitioner appears before the trial court within 15 days from today and files an application for recall of warrant and for grant of bail, the same shall be considered by the learned Magistrate, as expeditiously as possible, preferably on the same day itself.
The Crl.M.C. is disposed of as above.
