Judgment
Biswajit Palit, J
Learned Senior Counsel, Mr. Subrata Sarkar assisted by Learned Counsel, Mr. K. D. Singha and Learned Counsel, Ms. Ayesha Saha Hirawat is present for the accused. Learned P.P., Mr. Raju Datta along with Learned Addl. P.P., Mr. Rajib Saha is also present on behalf of the State-respondent.
Today Learned P.P. further sought for time to submit the report of CFSL.
The accused was granted interim bail by order dated 29.08.2024 subject to production of report of SFSL by the prosecution.
This is a case under NDPS Act. In earlier occasions also, Learned P.P. sought time on the same ground and that was accepted by the Court and prosecution was given the opportunity to submit the report of CFSL report because without the report of CFSL, it was difficult to substantiate the allegation levelled against the accused.
It appears that the manner in which the prosecution agency is seeking time repeatedly is not at all satisfactory. If necessary, one special messenger be sent to the Office of Director, CFSL, Assam to collect the report.
However, considering the nature and gravity of the offence, the period of interim bail of the accused be further extended till 30.04.2025 with a direction to the prosecution to produce the report of CFSL invariably before this Court on the next date.
No further time will be granted.
A copy of this order be furnished to Learned P.P. in course of the day to take up the matter with the appropriate authority failing which the Court will be under obligation to consider the bail application on merit in absence of report of CFSL.
