Judgment
In partial modification of the daily order dated 27th September, 2019, the last sentence of the daily order will read as Main CP and CA(IB) 508/KB/2019 to appear on 20.11.2019, instead of 20.12.2019, as mentioned earlier. Other contents of the order dated 27.09.2019 will remain same.
ORDER
Ld. RP appears alongwith the Ld. Counsel. Ld. Sr. Counsel for one of the secured creditors appears. CA(IB) 508/KB/2019 is filed by one of the member of the CoC challenging RP's action of voting share. Ld. Counsel for the RP seeks time to file reply. It is to be filed within seven days without fail by giving copy to the other side.
CA(IB) 1244/KB/2019 is filed by Suraksha ARC, one of the shareholder of the erstwhile corporate debtor challenging action of the RP's constitution of CoC and allotment of voting share. Apparently, application is not maintainable because shareholders of the corporate debtor does not have locus to file application challenging the RO's action by this way. Application stands disposed off and rejected.
CA(IB) 1243/KB/2019 is filed for considering EoI. CIRP is in progress and we have extended time of CIRP. Applicant is allowed to submit fresh EoI to RP and RP and CoC to take call on that. With this direction, CA(IB) 1243/KB/2019 stands disposed off. Main CP and CA(IB) 508.KB/2019 to appear on 20.12.2019 for further consideration.
