Judgment
Arindam Sinha, J
Ms. Vyas, learned advocate, appears on behalf of appellant and prays for further adjournment, as last chance and fixing the case on 3rd August, 2022. The ground is illness of her leader, down with COVID-19.
Respondent appears in person. He opposes the adjournment on submission that several adjournments were obtained on this very same ground. Considering this the appeal was fixed for hearing today.
Court has perused order-sheet. Prior to 6th April, 2022 both parties had sought adjournments, after which respondent started pressing for hearing. The appeal was moved on 6th April, 2022 and thereafter again there were some adjournments, taken lastly on behalf of appellant on lead counsel being unwell.
Submissions made on behalf of appellant have been recorded in brief. They were on preliminary objection regarding violation of provisions under section 27, Arbitration and Conciliation Act, 1996. Appellant remains to be heard on its other grounds of challenge.
List the appeal on 3rd August, 2022. It is made clear, in event appellant does not advance argument on adjourned date or thereafter, Court will proceed to hear respondent and deal with the appeal..
