Judgment
Prakash Tatia, J.—Heard learned Counsel for the petitioner.
The petitioner''s grievance is that he was given promotion by Departmental Promotion Committee (hereinafter referred to as the DPC) and that was for one year or till review DPC takes decision. Thereafter, the petitioner continued on the promotional post beyond the period of one year and no review DPC was convened. It is submitted that in view of the rules and particularly, Rule 28, the petitioner should have been treated to be promoted on regular basis for the purpose of grant of further promotions. It is submitted that after filing of the present writ petition, the DPC has already been convened and recommendations have been prepared and in view of the decision of the DPC the persons junior to the petitioner will be promoted accordingly.
What is the status of the petitioner in seniority as well as what is the petitioner''s right on the post in view of the DPC decision whereby he has been given promotion for one year or till the review DPC takes a decision can be well examined by the Service Appellate Authority. Therefore, this writ petition is not being entertained by this Court and therefore, on this ground alone, the same is dismissed with liberty to the petitioner to approach the appropriate forum for redressal of his grievance.
