G.Ilangovan, J
The petitioner/Accused herein, who was arrested on 03.07.2023 for the alleged offence under Sections 4(1)(a) of TNP Act r/w 4(1-A) of TNP Act, in Crime No.448 of 2023, on the file of the respondent police, seeks bail.
2.The case of the prosecution is that the accused was found in possession of 11 bottles of 180 ml of brandy without valid permit. Hence, the case.
3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. Hence, prays to release him on bail.
4.The learned Additional Public Prosecutor submitted that the petitioner is having 25 previous cases at his credit, out of which, 11 cases were disposed of and the remaining cases are pending. He is a habitual offender. Hence, prays to dismiss the petition.
5.Considering the nature of offence and bad antecedents of the petitioner, if he is released on bail, he may abscond or indulge in similar kind of offence. So this Court is not inclined to grant bail to the petitioner.
6.Accordingly, this Criminal Original Petition stands dismissed.
