Jeetendra vs The State of Rajasthan

Narendra Kumar Jain, J.—Heard learned Counsel for the parties.

Petitioner has preferred this writ petition contending therein that F.I.R. No. 624/2009 was registered at Police Station Nadbai, District Bharatpur, wherein initially Petitioner was not found accused, but on transfer of investigation of said FIR to C.I.D.(CB), Petitioner has unnecessarily been dragged and he is being implicated as an accused in the case, therefore, he submitted a representation dated 29.06.2011(Annexure-9) before the Director General of Police, Rajasthan, Jaipur to get the said FIR investigated from an officer of the level of Superintendent of Police, but No. heed was given to the said representation, therefore, present writ petition has been filed.

A notice to show cause was given to Respondents, but No. reply to writ petition has been filed.

During the course of arguments, the learned Additional Government Counsel submitted that a direction can be given to the Director General of Police to consider the representation of Petitioner and pass necessary order thereon, in accordance with law.

After considering the submissions of the learned Counsel for both the parties, I am of the view that a liberty can be granted to Petitioner to file a fresh representation along with copy of earlier representation dated 29.06.2011 to the Director General of Police, Rajasthan, Jaipur with a direction to consider the same, in accordance with law, and pass necessary order thereon.

Consequently, the writ petition is disposed off with liberty to Petitioner to file a fresh representation in respect of his grievance, which has been agitated in this writ petition, along with copy of his earlier application/representation dated 29.06.2011 and a copy of this order. If such a representation is filed within ten days, then the Director General of Police, Rajasthan, Jaipur, is directed to consider the same, sympathetically, and pass necessary order thereon, in accordance with law.

Since the writ petition itself has been disposed off, therefore, this stay application also stands disposed off.
