Judgment

Application is allowed subject to all just exceptions.
C.O.C.P. NO. 71 of 2008.
It is not in dispute that in compliance of the order dated 31.10.2007 passed by this Court in C.WJ�. No. 5355of 2007, an amount of Rs. 4,35,960/- has been paid to the petitioner. However, the grievance of the petitioner is that the aforesaid amount was to be paid to the petitioner within two months from the date of the aforesaid order whereas the due payment of the petitioner has been made after a lapse of almost two years and therefore, she is liable to be compensated by Way of costs/interest on this amount. The only explanation for the delayed payment furnished by the respondents is, paucity of funds.
Be that as it may, in my view, the petitioner has been denied her right to enjoy the aforesaid amount for a period of almost two years and therefore, she deserves to be compensated. Thus, in these circumstances, the petitioner be compensated by making additional payment of Rs. 25.000/- in lump sum.
Let the aforesaid amount be paid by the Muktsar Cooperative Marketing-cum-Processing Society. However, the Society will be at liberty to fix the responsibility upon the person(s) concerned for the delay caused in making the payment to the petitioner and recover the amount in accordance with law.
The Assistant Registrar Cooperative Societies, Muktsar-respondent No. 1 shall ensure the compliance of the order of this Court within two months.
