Judgment
T.R. Ramachandran Nair, J.—In W.P.(C) No.13442/2004 the petitioner who was appointed as a High School Assistant in a Panchayat school (recently taken over by Government) and subsequently appointed as Higher Secondary School Teacher in a Government school by transfer, has sought for various relief''s including a declaration that Ext.P5 order is valid in law. Apprehending steps for cancellation of Ext.P5, the writ petition was filed. In W.P.(C) No.32512/2004 the petitioner is appointed as High School Assistant in the vacancy caused due to the promotion of the petitioner in the connected writ petition as H.S.S.T. and the prayer sought is to direct approval of the appointment.
Learned counsel for the petitioner in W.P.(C) No.13442/2004 submitted that in respect of schools taken over by the Government from the Panchayats, Ext.P8 Government Order (G.O.(MS) No.20/2012/G.Edn. dated 20.1.2012) is issued with regard to the modalities for finalizing the seniority and other matters relating to the teaching and non teaching staff and in the light of Ext.P8 order, the first respondent may be directed to take
follow up action to determine and grant the various benefits.
As far as W.P.(C) No.32512/2004 is concerned, it is submitted by the learned counsel for the petitioner that the appointment of the petitioner has been approved and the petitioner is receiving salary and other benefits. There will be a direction to the first respondent to pass appropriate orders in respect of the petitioner in W.P.(C) No.13442/2004, in regard to seniority and allied matters, in terms of Ext.P8 order, within a period of four months from the date of receipt of a copy of this judgment.
The writ petitions are disposed of as above. No costs.
