The present bail application has been filed under Section 439 Cr.P.C. on behalf of the petitioners, who are in judicial custody in connection with F.I.R. No. 64/2022 registered at Police Station Shivpura District Pali for the offences punishable under Sections 457, 380, 436/34 & 120-B IPC.
Learned counsel for the petitioners submits that the accused-petitioners have been falsely implicated in the matter and no specific allegation is levelled against them in the FIR. Learned counsel further submits that ingredients of the FIR does not constitute any offence against the petitioners.
Per contra, learned AAG opposed the bail application.
Heard learned counsel appearing for the petitioners and learned AAG. Perused the material available on record.
Having regard to the facts and circumstances of the case, particularly the fact that perusal of the FIR and the photographs available on the case diary makes it clear that the shop in question has been burnt and the accused-petitioners have definitely been named in the FIR, this Court is not inclined to grant the benefit of bail to the accused-petitioners at this stage.
Accordingly, the present bail application preferred under Section 439 Cr.P.C is dismissed.
