Judgment
The petitioner by way of this petition seeks to challenge the FIR registered against him by his wife under Section 498A, 406 IPC.
Learned counsel for the petitioner submits that the FIR registered is absolutely false as the petitioner has never demanded any dowry from wife. On
the other hand, the wife had registered an FIR under Section 376, 384 IPC against one-Suresh Meena alleging that Suresh Meena had raped her and
also prepared a video clip which he sent to her husband and demanded an amount in blackmail while the said FIR is pending. Learned counsel submits
that it proves that the petitioner has been cheated by his wife and the entire FIR is false.
I have considered the submissions.
It is clearly a case where the girl was raped by some person and her video clip was prepared and she was being blackmailed when she was married
to the petitioner. It also shows prima facie that when the husband came to know about the said incident he has also started harassing and causing
cruelty on her.
In view thereof, the allegations which are mentioned in the FIR cannot be said in any manner to be false. The contention of the petition is wholly
misconceived.
The criminal misc. petition is accordingly dismissed.
