I have heard learned counsel for the appellant and have perused the judgment passed by the courts below. Admittedly there are concurrent findings of facts.

Mr. T.P. Singh, learned counsel for the appellant has, however, raised two points namely that suit for rendition of accounts is not maintainable and secondly the suit for rendition of accounts with regard to the recovery of rent is barred by limitation. After going through the impugned judgment, I, however, find that there is no substance in either of the contentions raised by learned counsel for the appellant. As far as maintainability of the suit of rendition of accounts is concerned, there is clear finding of fact that respondent was coonwer in the suit property and property had been given on rent on the basis of documents Ex. P/5 to Ex. P/8. As regards the contention of learned counsel with regard to the limitation, I find that point of limitation was not raised by the appellant in the courts below. Accordingly the appeal is dismissed.
