1 Reply filed on behalf of respondent No. 3 is taken on record.
2 It is the case of the applicant/appellants that the decision dated 21.7.2008 could not come to his knowledge as it was not communicated to him and he could come to know of it only when he visited the office of his counsel. The aforesaid ground for condonation of delay taken by the applicant/appellants though has been denied by respondent No. 3, however, the reply is vague.
3 Having heard learned counsel for the parties, I find sufficient reasons to condone the delay of 155 days in filing this appeal. Accordingly, the delay is condoned. Civil Misc. application stands disposed of. FAO No. 1911 of 2008
4 This appeal has been filed by the claimants for enhancement of compensation challenging the settlement of compensation taken before the Lok Adalat.
5 Since the impugned order has been passed on the basis of a compromise/settlement between the parties, this appeal is not maintainable. Appeal dismissed.
