M.R. Sharma, J.—The Additional Director, Consolidation of Holdings. Punjab, Chandigarh, vide his order dated 28th January, 1966 (Annexure ''A'') allowed a path to the Respondents from the land which the Petitioner claims to be belonging to him. This order has been challenged on the ground that the petition filed by the Respondents was hopelessly barred by time and the learned Additional Director did not give any reasons for waiving the time limit. Apparently, the Additional Director was aware of the rule regarding limitation. He noticed it and came to the conclusion that the request of the Respondents was genuine. In other words, in (order to do justice between the parties, he waived the lime limit. In Ebrahim Aboobakar and Another Vs. Custodian General of Evacuee Property, , it was laid down that it lies solely within the jurisdiction of the Administrative Tribunal to determine whether a petition filed before it is within time or not, or that the delay, if any, in filing the petition, should be condoned or not. In this view of the matter, I see no reason to interfere. This petition is, therefore, dismissed. No costs.
