Judgment
Manoj Kumar Tiwari, J
Petitioner filed an application under Section 7 of Guardians and Wards Act, 1890 for custody of his granddaughter (Ms. Saheb Kaur), aged about 2 years which is registered as Miscellaneous Civil Suit No. 5 of 2021 before Judge, Family Court, Kashipur, District Udham Singh Nagar.
By means of this writ petition, petitioner has sought a direction to the court concerned to expedite disposal of the aforesaid case.
Mr. Sanjay Kumar, learned counsel appearing for the petitioner submits that petitioner's daughter-in-law (mother of Ms. Saheb Kaur) has passed away and the maternal grandparents of Ms. Saheb Kaur are illegally having her custody, and they have not even cared to extend her VISA, which expired on 05.08.2021. He further submits that petitioner's son is residing at New Zealand, who also wants that the custody of his daughter should be given to the petitioner.
Having regard to the fact of the case, the writ petition is disposed of with a request to court concerned to make endeavour to expedite hearing of Miscellaneous Civil Case No. 5 of 2021. Unnecessary adjournment to the parties should be avoided.
