This Application has been filed by the applicants-Jasvinder Kaur and Bhupender Singh seeking anticipatory bail in Case Crime No.204 of 2025, registered at Police Station Bazpur, District Udham Singh Nagar under Section 420 of the Indian Penal Code, 1860.
As per the First Information Report dated 26.05.2025, the applicant no.1-Jasvinder Kaur is the mother of the informant and the applicant no.2 Bhupender Singh is the real brother of the informant. Informant’s father died on 26.11.2017. All three had equal shares in the property of the informant’s father. The property of the informant’s father was acquired. Compensation of Rs.40,69,083/-(Rupees Forty Lakh Sixty Nine Thousand Eighty Three) was fixed. The applicants took the entire amount by showing fake signature of the informant.
The Withdrawal Application (IA No.01 of 2025), filed by the applicant no.2, is taken on record.
Heard Mr. Girish Chandra Lakhchaura, learned counsel for applicants, Mr. Tumul Nainwal, learned Assistant Government Advocate for respondent and Mr. Abhishek Verma, learned counsel for informant.
Mr. Girish Chandra Lakhchaura, Advocate, submitted that the applicant no.2 does not want to press the present anticipatory bail application. He (applicant no.2) has filed his own affidavit (IA No.01 of 2025) in this regard.
On the request of the applicant no.2, the present anticipatory bail application is dismissed as withdrawn in respect of the applicant no.2-Bhupender Singh.
Mr. Girish Chandra Lakhchaura, Advocate, contended that the applicant no.1, aged about 69 years has been falsely implicated in the present matter. The property of her husband was acquired for construction of the National Highway No.74 and only an amount of Rs.10,78,933/-(Rupees Ten Lakh Seventy Eight Thousand Nine Hundred Thirty Three) as compensation was transferred in the account of the applicant no.1 on 11.08.2020.
Mr. Tumul Nainwal, Assistant Government Advocate, appearing for the State and Mr. Abhishek Verma, Advocate have opposed the anticipatory bail application.
Having heard the submissions of learned counsel for the parties and keeping in view of the facts and circumstances of the case, without commenting on the merits of the case, the present Application, filed for anticipatory bail, is allowed. It is directed that in the event of arrest of the applicant Jasvinder Kaur, she shall be released on anticipatory bail on executing a personal bond of Rs. 30,000/- and two reliable sureties, each of the like amount, to the satisfaction of the Arresting Officer, subject to the following conditions:-
(i) Applicant shall cooperate with the Investigating Agency and she shall make herself available for interrogation by a police officer as and when required;
(ii) If the charge-sheet is filed, the applicant shall attend the trial court regularly and she shall not seek any unnecessary adjournment;
(iii) Applicant shall not directly or indirectly make any inducement, threat or promise to any person, acquainted with the facts of this case;
(iv) Applicant shall not leave the country without the previous permission of the trial court.
It is made clear that if the applicant misuses or violates any of the conditions, imposed upon her, the prosecution agency will be free to move the Court for cancellation of the anticipatory bail.
