Judgment

Rule returnable forthwith. Mr. Hardik S. Soni, learned APP, waives service of notice of Rule for and on behalf of respondent – State.
This application is filed by the applicant for modification of Condition No. (d) to the extent that he be permitted to leave the territory of District: Mehsana for the purpose of attending the Court proceedings of trial before competent Court at Rajkot.
At the same time, he has prayed for change of residence, as the premises where applicant was staying caught accidental fire and it is not available to reside. However, considering the hardship caused to the applicant, condition No. (d) in order dated 23.03.2023 is now modified to the extent that he shall now not leave the limits of District: Ahmedabad, where he is presently residing, till the conclusion of trial except for the purpose of attending Court proceedings of trial before competent Court at Rajkot.
Condition No. (e) therein is also modified to the extent that he shall furnish the present address, as on date, of residence to the Investigating Officer as also to the Court, and shall not change the residence without the prior permission of the concerned trial Court.
The aforesaid order dated 23.03.2023 passed by this Court in Cri. Misc. Application No. 2737 of 2023 is hereby modified to the aforesaid extent.
Rule made absolute.
