Ram Chand Gupta, J.—This is an application for regular bail filed u/s 439 of Code of Criminal Procedure in FIR No.122 dated 01.10.2009 under Sections 307, 326, 324, 452, 148 read with Section 149 of Indian Penal Code, registered at Police Station Lambra District Jalandhar.

I have heard Learned Counsel for the parties and gone through the record.

It has been argued by the Learned Counsel for the petitioner that he has been continuing in custody since 15.07.2010 and that all the other accused are on bail either by this Court or by the Court of Sessions.

Further contends that main accused namely Jagdish alias Disha who allegedly gave kripan blow on the right side of head of complainant, had already been granted bail. Further contends that trial is not likely to be concluded in near future as only three witnesses have been examined so far.

Learned counsel for the State on the instructions of Head Constable Devjeet Singh, has not disputed these facts.

There are no allegations on behalf of the State that petitioner is likely to abscond or that he is likely to dissuade the witnesses from deposing true facts in the Court, if released on bail.

Hence, keeping in view these facts and without expressing any opinion on merits, the instant application for regular bail filed on behalf of Jaspal Singh @ Chiri @ Dinesh is allowed.

Bail to the satisfaction of CJM/Duty Magistrate, Jalandhar.
