Judgment
K.M. Joseph, J.—Petitioner approached this Court seeking the following prayers:
i) to issue a writ of mandamus or such other appropriate writ, order or direction, directing the respondents 1 & 2 to provide adequate police protection to life of the petitioner and his family members.
ii) to issue a writ of mandamus directing the respondents 1 to 3 to maintain law and order situation by preventing the 4th respondent from his illegal attempts to dispossess the petitioner from the property in her possession described as plaint schedule property in Ext.P2.
Petitioner is in possession and enjoyment of 2.850 cent of land comprised in Survey No. 2902/8/5 in Muttathara Village. It is alleged that respondent No. 4, who has no right over the property, attempted to trespass into the plaint schedule property. The petitioner has approached the Civil Court by filing O.S. No. 591/09. Petitioner has also obtained Ext.P4 order of injunction restraining the 4th respondent herein from trespassing and committing waste in the plaint schedule property. It is alleged that the 4th respondent is making threats to the life of the petitioner and her family even after Ext.P4 order. Therefore, petitioner has filed C.M.P. No. 1969/2010 before the Judicial Magistrate of First Class-II and the same has been forwarded to the 3rd respondent, Sub Inspector of Police, u/s 156(3) of the Code of Criminal Procedure.
We have heard learned Counsel for the petitioner and learned Government Pleader. Learned Counsel for the petitioner submits that petitioner seeks protection to her life and the life of her family members.
Learned Government Pleader, on getting instructions, submits that telephonic complaints were received which related to the violation of the order of injunction.
Petitioner has already approached the civil court and obtained an interim direction. It is for the petitioner to work out the remedies in the civil court. If the petitioner complaints of any cognizable offence before the 2nd or 3rd respondent as against the 4th respondent, the official respondent before whom the petitioner brings forth the complaint shall consider and take action in accordance with law.
Writ petition is disposed of as above.
