Judgment
Amrita Sinha, J.:-
Six petitioners have filed the instant writ petition. They participated in National Eligibility cum Entrance Test (UG), 2026 (NEET) in General and OBC category. Presently, the OBC status of some of the candidates has been cancelled due to several pronouncements of the Hon’ble Courts. All the petitioners pray to allow them to switch over from their respective category to Economically Weaker Section (EWS) category.
Some of the petitioners have already obtained EWS certificate after 1st April, 2026. Some are yet to receive the same and their application seeking EWS certificate is pending consideration.
The petitioners rely on the Notice cum Information Bulletin for NEET UG, 2026 counselling in West Bengal published by the Directorate of Medical Education, Government of West Bengal on 11th August, 2026 and submit that as some of the petitioners possess EWS certificate issued after 1st April, 2026, they ought to get the benefit of reservation.
Specific submission of the petitioners is that there is a provision for verification of EWS certificate at the time of counselling. The petitioners ought to be provided a scope to register themselves for counselling in the reserved category.
Prayer has been made to permit the petitioners who already possess EWS certificate to be provided the benefit of reservation and to issue EWS certificate to the petitioners who applied for the same, but are yet to receive it.
The issues raised by the petitioners have been dealt with by the Court in the judgment dated 14th August, 2026 passed in WPA 21501 of 2026 (Hasibur Rahaman Mondal & Ors. vs. State of West Bengal & Ors.). The Court after hearing the submissions made on behalf of all the parties dismissed the writ petition.
As the petitioners herein stand in the same footing as that of Hasibur Rahaman Mondal (supra), accordingly, no relief can be granted to the petitioners in the instant case.
The competent authority will take steps in accordance with law to dispose of the application filed by the petitioners seeking issuance of EWS certificate in their favour.
The writ petition fails and is hereby dismissed.
No costs.
