Concededly, W.P.(C)6935/2026, W.P.(C) 6984/2026 and W.P.(C) 5336/2026 are covered by the judgment rendered by a Division Bench of this Court in Delhi Building and other Construction Workers Welfare Board vs. Dulari Devi & Anr., 2024 SCC OnLine Del 3148.

Further, W.P.(C) 5109/2026 is covered in favour of the petitioner in terms of judgment passed by a Division Bench of this Court in National Campaign Committee for Central Legislation on Construction Labour vs. Delhi Building and other Construction Workers Board., 2024 SCC OnLine Del 1257.

The aforesaid writ petitions are, consequently, allowed in terms of Delhi Building and other Construction Workers Welfare Board vs. Dulari Devi &Anr., 2024 SCC OnLine Del 3148, and National Campaign Committee for Central Legislation on Construction Labour vs. Delhi Building and other Construction Workers Board., 2024 SCC OnLine Del 1257.

The limited relief sought in W.P.(C) 5112/2026, W.P.(C) 5714/2026 and W.P.(C) 5346/2026 is that the pending claim application/s of the concerned building worker be duly considered and decided. It is emphasized that the petitioners therein are fully eligible in terms of the extant statutory and rule position read with the aforesaid judgments.

During the course of hearing, learned counsel for the respondent accedes to the above, and submits the entitlement of the said petitioners shall be duly considered in accordance with law. It is submitted that for this purpose, a physical verification will be required to be carried out. Let the necessary verification exercise be done by the respondent and subject to completion thereof, necessary amount be disbursed to the petitioners.

Let the aforesaid exercise be concluded as expeditiously as possible and in any event within a period of eight weeks from today.

Interest as may be admissible under the relevant rules and in terms of the judgment dated 17.04.2023 rendered by the Division Bench of this Court in Rajo vs. Delhi Building and Other Construction Workers Welfare Board and Anr., 2023 SCC OnLine Del 2185 shall also be disbursed to the petitioners.

These petitions are disposed of in the above terms.
