Judgment

The petitioner has filed this Writ Petition seeking the following reliefs:-
(1)Â To issue a writ of mandamus or any other appropriate writ, order or direction commanding the respondents 1 & 2 to engage the 3rd respondent to conduct an
effective investigation in crime No.229/2020 of Tirur police Station.
(2)Â To issue a writ of mandamus or any other appropriate writ, order or direction commanding the respondents 1 & 2 to take disciplinary action against the 4th
respondent for not conducting any kind of investigation in crime no.229/2020 of Tirur police station even after the lapse of more than 9 months of its registration.
(3)Â And to pass such other appropriate writs, orders or directions which this Hon'ble Court deems fit and proper in the facts and circumstances of the case so as to
secure the ends of justice.

3. Heard the learned Public Prosecutor.
4. The learned Public Prosecutor, on instructions, submits that the 3rd respondent is the Station House Officer, Tirur Police Station, Chembra, Tirur,
Malappuram. Hence, the prayer sought for in this Writ Petition itself is wrong. The learned Public Prosecutor, on instructions, further submits that the
Police conducted the investigation in this case and after investigation, the police filed the final report referring the case as 'mistake of fact'. The
submission is recorded. In view of the fact that the case has been already referred, the further investigation, as sought for, is absolutely unwarranted.
In the result, this Writ Petition stands dismissed recording the submission of the learned Public Prosecutor.
