Petitioners seek quashing of FIR No.74 dated 11.05.2025 under Sections 419, 420 and 120-B Indian Penal Code and Section 82 Registration Act, 1908 Police Station Civil Lines, District Police Commissionerate, Amritsar, Punjab and all consequential proceedings arising therefrom, on the basis of compromise dated 03.07.2026.

On 11.08.2026, this Court directed the parties to appear before learned trial Court/Illaqa Magistrate for recording of their statements with regard to compromise dated 03.07.2026.

In compliance of the aforesaid order, parties appeared before learned Judicial Magistrate, First Class, Amritsar on 29.08.2026. Statement of Investigating Officer ASI Gurjit Singh was recorded on 01.09.2026. Learned Judicial Magistrate, First Class, Amritsar has submitted his report recording satisfaction that all the parties have entered into a valid compromise without any influence or coercion. Point-wise report as under has been submitted:

“1.

There are three accused persons arraigned in the present FIR namely:-(1) Jasdev Singh son of Late Ajit Singh, (ii) Sonia W/o Jasdev Singh, (iii) Kirandeep Kaur and Harpreet Kaur W/o Ranjit Singh @ Rinku arrayed as accused.

All the above-mentioned accused persons have appeared before the Trial Court and made their statements.

3.

As per the record of police, no additional accused has been added and made a party to the compromise.

4.

As per the police record, none of the accused person is absconder/proclaimed person(s).

5.

As per the police record, no offence has been added or deleted during the investigation.

6.

As per the police record, the investigation is not pending against the any of the accused. Moreover, no accused has been declared as innocent.

7 There is only one complainant/injured/aggreived person in the present case namely Gurpreet Kaur D/o Ajit Singh R/o 3186, Gali no. 2. Guru Teg Bahadur Nagar, Mohkampura, Amritsar and currently residing at Baba Deep Singh Colony, near Shaheeda Sahib Gurudwara, Amritsar.

There is only one complainant/injured/aggreived person in the present case namely Gurpreet Kaur D/o Ajit Singh and her statement has been recorded.

The investigating officer namely ASI Gurjit Singh no 105 have appeared and his statement has been recorded.

The present case is pending at the stage of arguments on framing of charges.

As per the statements of the parties, compromise is genuine, voluntarily and out of free will of the parties.

As per police record, no other criminal case or proceedings is pending against any of the accused person.”

Learned State counsel has not raised any dispute regarding the factum of compromise. Since the matter has been amicably resolved, continuation of the criminal proceedings would be an exercise in futility.

Following principles of law laid down by the Full Bench Judgment of this Court in “Kulwinder Singh and others Vs. State of Punjab and another” 2007(3) RCR (Criminal) 1052 and Hon’ble Supreme Court in “Gian Singh Versus State of Punjab and others”(2012) 10 SCC 303, the petition is allowed.

FIR No.74 dated 11.05.2025 under Sections 419, 420 and 120-B Indian Penal Code and Section 82 Registration Act, 1908 Police Station Civil Lines, District Police Commissionerate, Amritsar, Punjab and all consequential proceedings arising therefrom, are quashed qua the petitioners, on the basis of compromise dated 03.07.2026.

Pending applications, if any, stand disposed of.
