Judgment
Manoj Kumar Tiwari, J
WPMS No. 203 of 2020, filed by the petitioner, was disposed of with certain directions. In this contempt petition, it was alleged that opposite parties
have not carried out the directions issued by Writ Court.
Mr. J.S. Bisht, learned Standing Counsel for the opposite parties has referred to the compliance affidavit filed on behalf of opposite party no. 2.
Para 5 & 6 of the said affidavit are reproduced below:-
“5. That in this regard it is humbly submitted that the election of the Committee of Management of the Institution was held on 17.11.2020 and on
the same date the Election Proposal was forwarded to the office of the answering respondent for approval. However, after scrutiny of the said
proposal it was found that the Renewal of Registration of the Society running the Institute in question namely Shri Guru Nangar Public School
Dehradun has been expired on 10.10.2020.
That subsequently after completing all the necessary formalities by the concerned Society and the Institute, the answering respondent vide order
dated 22nd February 2021 granted approval to the newly elected Management Committee of the Institute by handing over the charge of the Institute
to the newly elected Committee and the Committee vide communication dated 23rd February 2021 has informed regarding taking over charge of the
Institute. The said Committee at present is functioning. True/correct typed version/copy of the Order dated 22.02.2021 and Communication dated
23.02.20221 regarding taking over charge are collectively being annexed as Annexure No. -1 to this affidavit.â€
From the perusal of the compliance affidavit, it is apparent that the direction issued by Writ Court has been complied with.
Accordingly, contempt petition is closed. Notices issued to the opposite parties are hereby discharged.
