Judgment

This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).
Heard learned counsel for the parties.
This is an application under Section-439 Cr. P.C for bail.
The petitioner is implicated in the offence punishable under Section-395 of the I.P.C read with Sections-25 & 27 of Arms Act on the allegation of committing dacoity in respect of 70 bags of Soya bean nuggets. The petitioner is stated to have been in custody since 09.10.2020.
It is submitted by learned counsel for the petitioner that, there is no record of past criminal antecedent against the petitioner. The only evidence occurring against the petitioner is stated to be the statement of the co-accused.
Regard being had to the facts and submissions, factum of permanent residence of the petitioner and the stage of the proceedings, it is directed that, the petitioner shall be released on bail by the learned J.M.F.C., Banpur in G.R. Case No. 476 (A) of 2019 on such terms and conditions as deemed just and proper in the facts and circumstances of the case.
The Bail Application is accordingly disposed of.
Urgent certified copy of this order be granted as per rules.
