Judgment
-ON the facts and circumstances of this case we consider that it will be reasonable, just and proper to settle the claim of the complainant by payment to him by the Insurance Company of an aggregate amount of Rs. 43,50,000/- in full and final settlement of all the claims that the complainant and his financial institutions have as against the Insurance Company under the policy in question. The Counsel appearing on both sides have agreed to this suggestion. Hence, by consent, it is ordered that the Insurance Company shall pay a sum of Rs. 43,50,000/- in full and final settlement of the claim made by the Complainant. The payment shall be made into the account of the Complainant in the State Bank of India, Rajpura Road Branch, Dehra Dun. Such payment shall be made mandatorily by the Insurance Company to the said Bank within one month from the date of receipt of a copy of this order. ON such payment all claims that the insured and his financial institutions have as against the Insurance Company under the policies in question will stand completely extinguished. Copies of this order will be issued forthwith to the Counsel appearing on both sides. Complaint allowed.
