Jamna Devi vs State of H.P. and Others

Justice Kurian Joseph, C.J.—The writ petition is filed with the following prayers:-

a) That impugned orders, Annexure P-2, dated 14.8.2002 and 8.5.2007 may very kindly be quashed and set aside.

b) That impugned auction notice Annexure:P-6, dated 5.10.2011 may also very kindly be quashed and set aside thereby restraint orders may kindly be passed against the respondent not to auction the hutments with further directions to the respondents not to evict the petitioner and similarly situate persons from the hutments.

c) That directions may be given to the respondents to resettle the petitioner and similarly situate as per resettlement plan of the State Government with respect to the hutments. Till then respondents may very kindly be restrained from dispossessing the petitioner and similarly situate persons forcefully.

Learned Additional Advocate General and learned counsel appearing for the third respondent submit that the petitioner has been found to be eligible person for allotment under the rehabilitation scheme. It is made clear that until the petitioner is rehabilitated in terms of the rehabilitation scheme, the petitioner shall not be evicted from the present hutment. It is also made clear that in the case of all those, who have been found eligible in terms of the rehabilitation scheme, they shall not be evicted from the present premises until they are appropriately rehabilitated under the scheme.

With the above observations, the writ petition stands disposed of, so also the pending application (s), if any.
